Hims & Hers GLP-1 Ozempic-Style Injections Deceptive Advertising Claims

Companies have recently been advertising a type of injectable weight loss drug called semaglutide, or GLP-1. Hims & Hers offer compounded semaglutide drugs, which are not FDA-approved, meaning the FDA has not evaluated the drug’s safety, effectiveness, or quality. In contrast, semaglutides like Ozempic and Wegovy are FDA-approved, and have gone through the rigorous testing necessary for FDA-approval. If you purchased a Hims & Hers weight loss drug advertised to have the same active ingredient as Ozempic or Wegovy, you may have a claim under California law.

The U.S. Food & Drug Administration (FDA) recently issued a Warning Letter to Hims & Hers Health, Inc. (the company behind hims.com and forhers.com), stating that the company marketed its compounded semaglutide products as having “clinically proven ingredients” and “the same active ingredient as Ozempic and Wegovy”—and that these claims were false or misleading.

According to the FDA, these compounded products are not FDA-approved and are misbranded under the Federal Food, Drug & Cosmetic Act. Under California’s consumer protection laws, you have rights when a product is misrepresented, marketed under false claims, or otherwise fails to deliver what was promised.
