Did you receive any emails containing promises of limited time sales or deals?

Zimmerman Reed is investigating potential consumer statute violations by companies that use email-based marketing to incentivize customers to open emails and shop sales.

The investigation focuses on violations of Washington’s Consumer Electronic Mail Act (CEMA), and violations of similar statutes in other states, which provide strong protections against unauthorized commercial emails.

If you have received an email describing a sale in the subject line, fill out our Case Review form to learn about your legal options.

What is the case about?

Many companies utilize commercial emails that tout limited sales to encourage users to make immediate purchases. Certain state laws impose liability on companies that send these commercial emails. People who receive misleading commercial emails may be entitled to compensation.

Who is affected?

You may be affected and eligible to participate if:

  1. You received a commercial email that included references to limited time sales, discounts, or promotions, or other misleading sale information; and
  2. You have access to or screenshots of the emails at issue.

What is the potential compensation?

CEMA is a powerful consumer protection statute that may provide for damages of $500 for recipients of commercial email messages in violation of the Act. Other state statutes provide monetary compensation in different amounts. Injunctive relief enjoining companies from sending misleading marketing and sale promotion emails may also be available under certain state statutes.
