Many companies’ online Terms of Service require that legal claims be resolved through individual arbitration rather than in court. Arbitration is a way to settle disputes outside of court, which means we will not be filing a traditional lawsuit. In arbitration, a neutral third party, called an arbitrator, determines how the legal claim should be resolved, much like a judge would do in court. It’s also possible that your claim may resolved before starting the arbitration process. We anticipate representing other people with similar claims at the same time.

Data breach details

In May 2026, Charter Communications reportedly suffered a massive security breach, resulting in the theft of millions of its Spectrum customers’ data.  According to those reports, a well-known hacking group, ShinyHunters, used a phishing voicemail to gain access to Charter’s customer service environment, which stored information on Charter’s tens of millions of customers.  Once inside, the hackers exported customer records, gaining access to customers’ names, email addresses, physical addresses, phone numbers, account plan details, and support ticket data.

The hackers also claim to have taken Customer Propriety Network Information (CPNI), which includes private information that records call details, service data, and billing records.  Charter disputes that the hackers accessed CPNI data.

What risks does a data breach create?

Being the victim of a data breach involving the theft of personal information can be a stressful and frightening experience. Data breaches can place the victims at an increased risk of fraud or identity theft, as their stolen data can be misused by criminal actors, often long after the breach itself.

In some cases, the information disclosed through a data breach can be exploited by criminals who may use stolen login information to commit fraud and identity theft. In other cases, the stolen information is sold online where it can be used to commit insurance, financial, or medical fraud or identity theft; to seek to gain access to accounts and applications; or to improperly gain additional information through social media attacks, phishing attacks, or other similar means. In other words, it is often impossible to know the true risks and effects of a data breach until long after the breach has occurred, as criminals may be analyzing and aggregating the stolen data into comprehensive identity theft packages. This is why holding businesses accountable is important.
