What’s Going On?
An investigation by Consumer Reports revealed that TikTok has collected individuals’ internet browsing data from websites even if those individuals don’t have a TikTok account. According to the report, “TikTok, one of the country’s most popular apps, is partnering with a growing number of other companies to hoover up data about people as they travel across the internet,” including for “people who don’t have TikTok accounts.” Consumer Reports found that the “data being transmitted to TikTok can include your IP address, a unique ID number, what page you’re on, and what you’re clicking, typing, or searching for, depending on how the website has been set up.”

Companies sharing consumer information with TikTok raises serious privacy concerns. In April 2024, the United States passed a law requiring TikTok to be sold by its China-based owner due to “concerns among lawmakers and security experts that the Chinese government could tap TikTok’s trove of personal data about millions of U.S. users.”

What is this Case About?
ZR is representing individuals who are pursuing privacy claims against Birkenstock for facilitating TikTok’s surveillance of individuals who visited the Birkenstock website. We allege that Birkenstock aided TikTok’s surveillance by knowingly installing the TikTok tracking software on the Birkenstock website and not telling its website visitors that their information was being disclosed to TikTok.
We plan to pursue these claims in arbitration rather than filing a traditional lawsuit in court. Birkenstock requires that any disputes related to the use of its website be submitted in arbitration. In an arbitration forum, a neutral third party (called an arbitrator) determines how the disagreement should be resolved, much like a judge would do in court. In this case, we would be asking the arbitrator to award you financial compensation for privacy violations stemming from the disclosure of your information to TikTok.
