What is this About?

Gold and silver can be legitimate investments. The issue is how much you were charged to buy them.

Some precious-metals dealers allegedly attract customers who are concerned about inflation, instability in the financial system, or the declining value of the dollar—and then encourage them to move retirement savings into gold or silver.

Instead of ordinary bullion, customers may be steered into coins described as:

  • “Exclusive”
  • “Investment Grade”
  • “Semi-Numismatic”
  • “Limited Mintage”
  • “Collectible”

These coins may be sold at prices far above the value of the gold or silver they contain.

A recently filed California lawsuit, for example, alleges that one retired investor transferred $352,144 from her IRA to purchase precious metals. But after the transaction, her IRA custodian reportedly showed a value of only about $202,000.

Zimmerman Reed is investigating transactions involving the following companies:

What Can I Do?

Fill out a free case review form. You may have a claim if:

  • You moved money from an IRA, 401(k), or other retirement account to buy gold or silver
  • A salesperson warned you about a stock-market crash, banks, inflation, or the U.S. dollar
  • You wanted ordinary bullion but were encouraged to buy “exclusive,” “semi-numismatic,” or “investment-grade” coins
  • You were not clearly told the dealer’s markup, spread, or commission
  • Your account value dropped substantially after the purchase
  • You later discovered the coins were worth far less than you paid

You do not need to know whether you were overcharged. An invoice or IRA statement may allow us to evaluate the transaction for you.

How Large Can the Markup Be?

The Commodity Futures Trading Commission has warned that ordinary bullion generally carries a relatively modest dealer premium, while premiums on numismatic coins can be substantially higher.

A recent lawsuit against American Hartford Gold alleges that customers were sometimes sold coins for 100% to 300% more than their intrinsic gold or silver value.

That means that even if the price of gold rises significantly, the investor might still lose money.

Industry Enforcement History

Regulators have scrutinized precious-metals sales practices for years, particularly where retirees are steered from ordinary bullion into higher-priced coins. In 2015, the Santa Monica City Attorney obtained a $2 million judgment against Merit Financial after alleging that customers responding to low-cost bullion advertisements were steered into coins priced roughly 20%–40% over cost. In 2022, the New York Attorney General secured a $6 million settlement with Lear Capital after alleging that consumers, including retirees, were charged undisclosed commissions of up to 33%.

More recently, Rosland Capital filed for Chapter 11 bankruptcy in 2026 amid reported customer claims and regulatory inquiries. That same year, the New York Attorney General separately warned that older consumers were increasingly being targeted in gold-related schemes, underscoring regulators’ continued concern about the exploitation of retirement savings through precious-metals transactions.

What am I Signing Up for by Filling Out the Form?

Many companies’ online Terms of Service require that legal claims be resolved through individual arbitration rather than in court. Arbitration is a way to settle disputes outside of court, which means we will not be filing a traditional lawsuit. In arbitration, a neutral third party, called an arbitrator, determines how the legal claim should be resolved, much like a judge would do in court. It’s also possible that your claim may resolved before starting the arbitration process. We anticipate representing other people with similar claims at the same time.

Will this cost money?

You will not be responsible for any fees or costs unless we obtain compensation for you. If we are not successful, you owe nothing.
