Guests who rent properties may be owed interest on funds that are required to be deposited at the time of booking. Zimmerman Reed LLP is currently investigating whether interest that is earned on funds held in escrow by Airbnb should be paid to renters under applicable law.
When guests book a property on the Airbnb platform, they are typically required to immediately deposit funds for the rental—those funds are held until the completion of the stay and then forwarded to the host. When bookings are made far in advance of the stay, the deposited funds may earn interest during the time between the booking and the stay. However, according to reports, Airbnb keeps that interest for itself rather than providing the money to the guest whose funds earned the interest. That may violate the law.
