Did you receive an unwanted "Refer-a-Friend" text message?
Zimmerman Reed is investigating potential consumer privacy violations by companies that use text-based marketing programs to incentivize customers to send promotional referral messages.
The investigation focuses on violations in Washington state of the Consumer Electronic Mail Act (CEMA), which provides strong protections against unauthorized commercial text messages.
If you live in the state of Washington and have received a spam text (SMS) message with a promotional referral code, fill out our Case Review Form to learn about your legal options.
What is this case about?
Many companies utilize “refer-a-friend” programs via SMS/text message that provide incentives (like cash, discounts, or rewards) to encourage users to send promotional texts on their behalf.
Washington’s CEMA law imposes liability on companies that assist in sending referral text messages without the consent of the recipient. People who receive unwanted spam “refer-a-friend” text messages may be entitled to up to $500.
Who is affected?
You may be affected and eligible to participate if:
- You are a Washington resident;
- You received an unsolicited text message containing a referral code, discount, or promotional link for a company or service;
- You did not provide prior express written consent to receive the text; and
- You still have the text message and can provide a screenshot.
What is the potential compensation?
CEMA is a powerful consumer protection statute that provides for statutory damages of $500 for recipients of unsolicited commercial text messages in violation of the Act.
