SKIMS Website Tracking Investigation

Zimmerman Reed is investigating allegations that certain companies may have used software that tracked certain activities of individuals who accessed their website. Tracking website activates without the appropriate consent may violate state wiretapping laws and entitle website visitors to statutory damages up to $5,000 in some states.

What’s the conduct at issue?

SKIMS allegedly used software programs to record website visitors’ activity while on their site, regardless of whether the visitor ever clicks or submits anything and without the visitor’s consent.  This may include information that the user may not want anyone to know, such as information typed but not clicked for submission.
