Zimmerman Reed is investigating allegations that the largest producers of frozen potato products (including French fries, hashbrowns, tater tots, and other products) have engaged in price fixing and other anti-competitive behaviors resulting in artificially high prices. This practice would constitute a violation of the antitrust laws.
If you bought any frozen potato products for your business’s use, you may have paid too much, and we may be able to help you recover some of what you paid.
Specifically, we are looking to speak with restaurant owners and commercial food preparation businesses that have purchased frozen potato products from one of the following brands through a food service distributor or wholesaler:
- Lamb Weston
- McCain Foods
- R. Simplot
- Cavendish Farms

Background
The frozen potato product market is dominated by four large producers. Lamb Weston, McCain Foods, J.R. Simplot, and Cavendish Farms combine to control 97-98% of the frozen potato product market. A small number of companies holding such a substantial amount of market power in a market such as this gives large producers leverage and the opportunity to influence prices throughout the market.
Recent lawsuits have alleged that, beginning in January 2021, these producers agreed to impose lock-step price increases. Since 2021, the prices of frozen potato products have risen dramatically, even while the producers’ input costs declined. The lawsuits further allege that the producers were able to effectuate and monitor their agreement through an information sharing service called PotatoTrac.
